Terms and Conditions

For good and valuable consideration, the sufficiency and receipt of which are hereby acknowledged, I authorize SUPERMARKETGURU.COM (SG) & CONSUMER INSIGHT, INC. (CI) and SG & CI joint venture partners, vendors, production companies, and programming and content distributors (and their respective parents, affiliates, subsidiaries, licensees, successors, and assigns) (collectively, SG & CI Parties), to make use of the images, video, and/or any other audio or visual materials submitted hereunder, as well as my name, voice, likeness, and appearance therein, together with the personally identifying information I provide on the connection therewith (collectively, Video Submission), as further described below.

SG & CI Parties' Right to Use My Video Submission. I grant SG & CI Parties the right to edit in any manner, and to use and license others to use, my Video Submission, or any portions, reproductions or versions thereof, on SG & CI's Web sites and or in any other SG & CI Parties' Web sites, products or services (in any and all media, now known or hereafter invented including, without limitation, television, home video/dvd, and mobile services), an unlimited number of times, in perpetuity, throughout the world, with or without charge or cost to end users or other third parties. I also grant SG & CI Parties the right to use and license others to use my Video Submission in the promotion of such Web sites, products and/or services, to the same extent permitted for use of the Video Submission hereunder.

Clearance of My Video Submission for SG & CI Parties' Use. I represent and warrant that my Video Submission is my original work and that I have secured any and all rights, releases and permissions necessary for SG & CI Parties' use of the Video Submission hereunder, including without limitation those related to any people, places, music, performances of dance or music, video, photographs, and/or graphics in my Video Submission (collectively, Elements). I represent and warrant that, to the best of my knowledge, no further permissions or fees are due for SG & CI Parties' use of my Video Submission or any Elements therein. I further represent and warrant that any statements made by me or others in the Video Submission are true to the best of my knowledge and that neither they, nor any Element of the Video Submission, will violate any law or regulation violate or infringe upon the rights of any third party.

Waiver of Right of Approval. I hereby waive any right of inspection or approval of my Video Submission as used by SG & CI Parties, including without limitation any approval of my appearance and/or use of my name therewith or the uses to which they may be put.

Release and Waiver; Indemnification. I acknowledge that SG & CI Parties will rely on this License, Release and Waiver, potentially at substantial cost to them, and hereby waive the right to assert any claim of any nature whatsoever against any party relating to the exercise of the rights and permissions granted hereunder. I agree to indemnify, defend and hold harmless SG & CI Parties from any and all claims arising from their use of my Video Submission as permitted herein.
